I refer to the grant of additional years under that section to officers who retire before reaching the age of 55, which was normally in force at the time they entered the service of Hong Kong. The proviso cannot, therefore, be applied to fairly consider his case as per your despatch No. 139 of May 1897. It is thought that this view was taken in the Colony in the case of T. Swritte where an addition under the 24th clause of 1st year was made although he did not retire before reaching the age of 55 years.
4. The addition made to Mr. Omnaby's pension under Clause 20 of the Pension Minute would therefore be 8 years and 10 months instead of 4 yrs. 5 months, provided that the addition in his case be greater as he had long public employment of forty years.
